Terms of Use

Nexcrate Studio Pvt. Ltd.
(DBA Juicebox)

These Terms govern your use of this website. They are not the terms on which we carry out client work; those are set out in the documents we sign for each engagement, and clause 19 explains how the two fit together. Clause 3 is also our privacy notice, because we do not keep a separate one.

We are based in India and most of the people reading this are not. Clauses 1 to 24 apply to everyone. Schedules A, B and C set out additional terms for the European Economic Area, the United Kingdom and Switzerland; the United States; and Australia and New Zealand. Where a Schedule differs from the main body, the Schedule governs for the people it covers.

If anything here is unclear, write to us before you rely on it. We would rather explain a clause than argue about it later.

2.0

How these Terms apply to you

2.1

These Terms form a contract between you and us. Under section 10A of the Information Technology Act, 2000 of India, and under comparable electronic transactions legislation elsewhere, that contract is not unenforceable merely because it was formed electronically.

2.2

By using this website you accept these Terms. Where we ask you to tick a box, click a button or otherwise confirm acceptance before you submit information to us, that action is your acceptance and we will keep a record of it.

2.3

Clauses 13 (material you send us), 17 (indemnity), 18 (liability) and 20 (disputes) impose obligations on you or limit what you can recover from us. Those clauses bind you only if you have accepted these Terms in the manner described in clause 2.2, or have otherwise had a reasonable opportunity to read them before acting. We do not seek to enforce them against a person who has done no more than read a page.

2.4

If you do not agree to these Terms, please do not use this website.

2.5

This website is a professional portfolio and is not directed at children. We do not knowingly collect personal data from anyone below the age at which the applicable law requires parental consent, and we handle any such data only as permitted by section 9 of the Digital Personal Data Protection Act, 2023 of India, Article 8 of the General Data Protection Regulation, the Children’s Online Privacy Protection Act of the United States and comparable law. If you believe we hold a child’s personal data, tell us at hey@jxbx.it and we will delete it.

2.6

If you use this website in the course of your employment or on behalf of an entity, you confirm that you are authorised to accept these Terms on that entity’s behalf.

2.7

We recommend that you keep a copy of these Terms. Earlier versions are available on request.

3.0

Personal data, cookies and additional terms

3.1

Controller and scope. Nexcrate Studio Pvt. Ltd. is the controller of personal data collected through this website. We do not maintain a separate privacy policy or cookie policy. This clause is our privacy notice for the purposes of Article 13 of the EU and UK General Data Protection Regulations, section 5 of the Digital Personal Data Protection Act, 2023 of India, and comparable law. All questions and requests go to hey@jxbx.it.

3.2

What we collect. We collect two things. First, the information you give us when you contact us, being your name, email address, the organisation you represent, and the contents of your message and any attachment. Second, technical information generated when you visit, being your IP address, browser and device type, approximate location derived from your IP address, the pages you view and the site you arrived from. Technical information is recorded in our hosting logs and by Visitors, the analytics service we use.

3.3

What we do not want. We do not ask for and do not want special category or sensitive personal data, financial account details, payment card numbers or government identifiers. Please do not send them to us through this website.

3.4

Why we use it, and on what basis. We use the information you give us to reply to you and to assess a possible engagement. Our basis is that the processing is necessary to take steps at your request before entering into a contract, and our legitimate interest in operating a professional services business. We use technical information to operate, secure and improve this website, on the basis of our legitimate interest in keeping it working and free from abuse. We use either where we are required to by law. We send marketing only to people who have asked for it, and you can stop it at any time by replying to any message.

3.5

Who processes it. Our infrastructure is provided by GoDaddy, which registers our domain, Google, which provides our email, and Visitors, which provides our analytics. Each acts on our instructions under a written agreement. We disclose personal data to our professional advisers where necessary, and to a public authority where the law requires it. We do not sell personal information and we do not share it for cross context behavioural advertising, as those terms are used in the California Consumer Privacy Act.

3.6

How long we keep it. Enquiries that do not lead to an engagement are deleted twenty four months after our last contact with you. Records relating to an engagement are kept for the period required by Indian tax and company law and for eight years after the engagement ends. Hosting and analytics records are kept for the retention period offered by the relevant provider and no longer than twenty four months.

3.7

Where it goes. We operate from India, and our providers process data in the United States and elsewhere. India is not the subject of an adequacy decision under Article 45 of the General Data Protection Regulation. Where you contact us from the European Economic Area, the United Kingdom or Switzerland, the transfer of your message to us is necessary in order to take steps at your request before entering into a contract, which is a lawful basis for transfer under Article 49(1)(b). Where we transfer personal data on any other basis, we rely on Standard Contractual Clauses or another approved mechanism, and you may ask us which applies to you.

3.8

Your rights. Subject to the law that applies to you, you may ask us for a copy of the personal data we hold about you, ask us to correct or delete it, ask us to restrict or stop a particular use, object to processing carried out in our legitimate interest, ask for a portable copy, and withdraw any consent you have given. Write to hey@jxbx.it. We will respond within thirty days, or sooner where the law requires. If you are not satisfied, you may complain to the Data Protection Board of India, or to the supervisory authority in the country where you live if that is elsewhere.

3.9

Cookies and similar technologies. This website sets only what is necessary for it to function and to remain secure. If our analytics or any other service we add stores or reads information on your device that is not strictly necessary, we will ask for your consent before it is set, and declining will be as straightforward as accepting. We do not use advertising cookies and we do not permit third parties to track you across other websites from here.

3.10

Security. We take reasonable technical and organisational measures to protect the information we hold, but no method of transmission or storage is completely secure and we cannot guarantee absolute security. Please read clause 13 before sending us anything sensitive.

3.11

Representatives. [We have not appointed a representative under Article 27 of the EU or UK General Data Protection Regulation, on the basis that our processing of the personal data of people in those territories is occasional, does not involve large scale processing of special category data, and is unlikely to result in a risk to their rights and freedoms. Where that ceases to be the case we will appoint one and name it here.]

3.12

Additional terms. Certain features of this website may carry their own terms, which we will show you before you use the feature. Those terms apply alongside these Terms and prevail only to the extent of any inconsistency.

4.0

Changes to these Terms

4.1

We may amend these Terms for a valid reason, including to reflect a change in our services, in the technology behind this website, in our business practices, or in applicable law or regulatory guidance.

4.2

We will publish the amended Terms on this page with a new version number and effective date. Where an amendment materially reduces your rights or increases your obligations, we will take reasonable steps to bring it to your attention before it takes effect.

4.3

Your continued use of this website after the effective date constitutes acceptance of the amended Terms. If you do not accept them, your remedy is to stop using this website, which you may do at any time and at no cost.

4.4

Amendments are not retrospective and do not affect a right or liability that accrued before the effective date.

5.0

Availability of this website

5.1

This website is provided free of charge. We do not guarantee that it will be available, uninterrupted, timely, secure or error free.

5.2

We may update, alter, suspend, restrict or withdraw all or part of this website. Where we withdraw it permanently and it is reasonably practicable to give notice, we will.

5.3

If other people access this website through your connection or device, you are responsible for making them aware of these Terms.

6.0

Intellectual property

6.1

We own, or hold a licence to use, all intellectual property rights in this website and in the material published on it, including the text, layouts, illustration, motion work, photography, film, audio, code, design systems and case study content (“Our Content”). Our Content is protected by copyright, trade mark, design and unfair competition laws in India and, under the Berne Convention and related treaties, in substantially every country from which this website can be read.

6.2

You may view this website and print or download extracts from it for your own personal, non-commercial reference. All other rights are reserved.

6.3

You must not:

(a) modify any copy of Our Content that you have printed or downloaded;

(b) use any image, animation, film or graphic separately from the text it accompanies;

(c) use any part of Our Content for a commercial purpose without our prior written licence;

(d) remove or obscure any copyright, trade mark, credit or proprietary notice; or

(e) present Our Content, or any adaptation of it, as your own work.

6.4

Where we or a contributor are identified as the author of material on this website, that attribution must be preserved. Nothing in these Terms grants you any licence, by implication, estoppel or otherwise, in our trade marks, brand assets, trade secrets or underlying design work.

6.5

If you use any part of this website in breach of this clause, your permission to use it ends immediately and you must, at our election, destroy or return any copies you have made.

6.6

Nothing in this clause restricts an act permitted under section 52 of the Copyright Act, 1957 of India, the fair dealing provisions of the Copyright, Designs and Patents Act 1988 of the United Kingdom, the fair use doctrine under United States law, or any equivalent exception available to you that cannot be excluded by contract.

6.7

If you believe that material on this website infringes your rights, write to hey@jxbx.it identifying the material, the right you say is infringed, and how we can reach you. We will investigate and, where the claim is well founded, remove or amend the material.

7.0

Client work shown on this website

7.1

The case studies on this website describe work produced for and with our clients. Client names, logos, product names, trade marks and screenshots belong to those clients or their licensors. We publish that material either with the client’s permission or after the work has been made public by the client.

7.2

The appearance of a client’s name or mark does not imply that the client endorses us, or that any relationship between us continues, unless we say so expressly. Ownership of deliverables in any engagement is governed by the agreement for that engagement and not by this website.

7.3

If you are a client or a rights holder and consider that material has been published here without the necessary permission, write to hey@jxbx.it. We will take the material down while we investigate.

8.0

Performance figures and claims

8.1

Any statistic, outcome or performance figure published on this website, including figures relating to funds raised by client teams, user numbers, projects delivered and client retention, is stated as at the date shown alongside it or, where no date is shown, as at the date of the most recent update to that page.

8.2

Those figures are compiled from our own project records, from information reported to us by clients, and from publicly available sources. They describe past projects. They are not a forecast, a promise or a guarantee of any result in your matter, and no engagement should be entered into in reliance on them.

8.3

We hold supporting records for the figures we publish and will provide the basis for a specific claim on written request to hey@jxbx.it.

9.0

Acceptable use

9.1

You must not use this website:

(a) in a way that breaches any law or regulation applicable to you;

(b) for an unlawful, fraudulent or deceptive purpose;

(c) to obtain or attempt to obtain unauthorised access to this website, our systems, servers, networks or any connected computer resource, conduct which may give rise to liability under sections 43 and 66 of the Information Technology Act, 2000 of India, the Computer Misuse Act 1990 of the United Kingdom, the Computer Fraud and Abuse Act of the United States and comparable legislation;

(d) to harass, threaten, defame, impersonate or stalk any person;

(e) in a manner that is obscene, or discriminatory on grounds of religion, race, caste, colour, national origin, sex, gender identity, sexual orientation, age, disability or place of birth;

(f) to collect or store another person’s personal data without a lawful basis;

(g) to transmit unsolicited advertising or commercial solicitations;

(h) to reverse engineer, decompile or disassemble any part of this website, except where that restriction is prohibited by law;

(i) to impair or disrupt this website or any other person’s use of it, including by denial of service attack;

(j) to frame, mirror or embed any part of this website within another site; or

(k) to reproduce, adapt, translate, sub-licence, distribute, rebrand or resell this website or any part of it.

9.2

We may restrict or terminate your access to this website where you are in material breach of clause 9.1. Where the breach is capable of remedy and the circumstances allow, we will give you notice and an opportunity to remedy it first.

9.3

You are responsible for your own device, connection and data charges.

10.0

Indexing, retrieval and AI systems

10.1

We want this website to be found, including by machines. This clause draws the line at use rather than at access.

10.2

Permitted. You may crawl, index, cache, cite, quote to a reasonable and proportionate extent, and link to this website for the purposes of search, discovery, and generating a response to a user’s query in real time, provided that this website is identified as the source and any link to it is preserved. This permission is subject to our robots.txt file and any other machine readable directive we publish, which prevail over this clause to the extent of any conflict.

10.3

Not permitted. You must not access, scrape, harvest, mine or bulk extract this website or any part of it for the purpose of:

(a) creating, training, pre-training, fine tuning or otherwise adjusting the parameters or weights of any machine learning model, generative model or artificial intelligence system;

(b) constructing or maintaining a dataset, corpus or index that persists beyond the response to an individual user query and that reproduces a substantial part of Our Content; or

(c) creating a product or service that substitutes for access to this website.

10.4

For the avoidance of doubt, retrieving and citing a passage in order to answer a user’s question falls within clause 10.2. Retaining that passage in a training set or a permanent corpus falls within clause 10.3.

10.5

You must not use automated means that impose an unreasonable load on our infrastructure or that circumvent rate limits, access controls or authentication.

10.6

Our creative output, including identity systems, motion work, illustration, layouts and imagery, must not be used as training data or as reference material for a generative model, however obtained.

10.7

Reservation of rights. This clause is an express reservation of our rights under contract and under copyright law. It is made in particular for the purposes of Article 4(3) of Directive (EU) 2019/790 and its national implementations, and of the corresponding provisions of United Kingdom law. We also express this reservation in machine readable form in our robots.txt file and in metadata published with Our Content.

10.8

Where applicable law does not permit us to restrict a particular activity by contract, this clause applies only to the extent that it does.

11.0

Sanctions and restricted parties

11.1

This clause applies where you make an enquiry through this website, correspond with us, or enter into or seek to enter into an engagement with us. It does not apply to reading this website.

11.2

You confirm that you are not, and are not owned or controlled by, a person designated on a restricted party list maintained by the United Nations Security Council, the Government of India, the United States, including the Specially Designated Nationals and Blocked Persons List, the European Union or the United Kingdom, and that you are not located in or organised under the laws of a territory subject to comprehensive economic sanctions.

11.3

We may decline to correspond with or act for any person where doing so would place us in breach of applicable sanctions or export control law. We will tell you that we are declining, so far as we are permitted to do so.

12.0

Linking to this website

12.1

You may link to our home page provided you do so fairly and lawfully and do not damage or take unfair advantage of our reputation.

12.2

You must not link in a way that suggests an association, approval or endorsement that does not exist, or from a site that you do not own or control, and you must not frame this website within another. Any site linking to ours must comply with clause 9.

12.3

We may withdraw permission to link on notice, acting reasonably.

13.0

Material you send us

13.1

This clause applies to briefs, documents, files, messages and other material you send us through this website or to an address published on it.

13.2

Your position. You confirm that you own or control the rights in the material you send, that it is accurate so far as you are aware, and that sending it to us does not infringe any third party’s rights. Any moral rights you hold remain yours.

13.3

Our duty of confidence. We treat a brief, proposal, budget, roadmap, unreleased product information or anything you identify as confidential as confidential, whether or not an agreement has been signed. We will use it only to respond to you and to evaluate a possible engagement, will disclose it only to those within our studio who need it, and will not publish it or use it for any other purpose without your written consent. This duty continues for three years from the date you send it, and indefinitely in respect of anything that constitutes a trade secret.

13.4

Limits of that duty. It does not extend to information that is already public, that we already held without a duty of confidence, that we develop independently, or that we are required to disclose by law or by a regulator. It is not a substitute for a signed non-disclosure agreement, and if the matter warrants one, tell us and we will put one in place before you send anything.

13.5

Licence. You grant us a non-exclusive, royalty free licence to store and reproduce the material solely for the purposes set out in clause 13.3 and to keep it in our internal records. We acquire no ownership in it.

13.6

Unsolicited ideas. Please do not send us unsolicited concepts, designs or proposals for our own business. If you do, we may use them without obligation to you and clause 13.3 does not apply to them, unless you asked us first and we agreed in writing.

13.7

We may delete material that does not comply with clause 9, and we may disclose your identity to a person making a substantiated claim that material you sent infringes their rights, or where we are required to do so by law.

14.0

This website is not advice

14.1

The content of this website is general information about our studio and our work. It is not professional, legal, financial, tax or technical advice, and you should not act or refrain from acting on it without taking your own advice.

14.2

Nothing on this website is investment advice or research, or an offer, invitation, inducement or recommendation to acquire, dispose of or deal in any security, digital asset, token or virtual digital asset. We are not registered with the Securities and Exchange Board of India as an investment adviser or research analyst, we are not registered with the United States Securities and Exchange Commission in any capacity, we are not authorised by the Financial Conduct Authority of the United Kingdom, and we do not carry on any activity requiring such registration or authorisation.

14.3

Showing a client’s work is a record of design delivered. It is not an endorsement of that client’s product, protocol, token or business, and we accept no responsibility for your dealings with them.

14.4

We take reasonable care to keep this website current but do not warrant that it is accurate, complete or up to date.

15.0

Third party websites

This website links to websites and resources operated by others. Those links are provided for information and you follow them at your own risk. We do not monitor or control their content, and a link is not an endorsement.

16.0

Security

16.1

We take reasonable technical and organisational measures to protect this website, but we do not warrant that it is free from bugs, errors or malicious code. You are responsible for configuring your own devices and for maintaining your own protection.

16.2

You must not knowingly introduce a virus, trojan, worm, logic bomb or other malicious material, attempt to obtain unauthorised access to this website or any server or database connected to it, or attack it by denial of service or similar means. Conduct of that kind may be a criminal offence in your jurisdiction and in ours. We will report it to the relevant authorities, cooperate with them including by disclosing your identity, and terminate your access immediately.

17.0

Indemnity

17.1

This clause applies only if you are using this website for business purposes. It does not apply to consumers.

17.2

You will indemnify us against losses, liabilities, damages, claims, costs and reasonable legal expenses that we incur arising out of:

(a) your breach of clause 6, clause 9 or clause 10; or

(b) a third party claim that material you sent us under clause 13 infringes that party’s rights.

17.3

The indemnity does not apply to the extent that the loss arises from our negligence, wilful misconduct or breach of these Terms, or from our failure to comply with clause 17.4.

17.4

We will notify you promptly of any claim to which this indemnity applies, will not admit liability or settle without your consent, not to be unreasonably withheld or delayed, will allow you to conduct the defence of the claim if you elect to do so, and will take reasonable steps to mitigate the loss.

17.5

We will indemnify you on the same terms against any third party claim that Our Content, used by you as permitted under clause 6.2, infringes that party’s intellectual property rights.

18.0

Our liability to you

18.1

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, for gross negligence or wilful misconduct, or for any liability that cannot lawfully be excluded or limited under the law applicable to you. Nothing in these Terms affects a non-excludable statutory right or remedy available to you as a consumer.

18.2

Subject to clause 18.1, and to the fullest extent permitted by law, we exclude all implied conditions, warranties, representations and terms that would otherwise apply to this website or its content, including implied warranties of merchantability, satisfactory quality, fitness for a particular purpose and non-infringement.

18.3

Subject to clause 18.1, and to the fullest extent permitted by law, we are not liable to you, whether in contract, tort including negligence, breach of statutory duty, restitution or otherwise, for loss of profits, revenue, sales, business, anticipated savings, business opportunity, goodwill or reputation, for business interruption, for loss or corruption of data, or for any indirect, incidental, special, punitive or consequential loss, in each case whether or not foreseeable.

18.4

Subject to clause 18.1, our total aggregate liability to you arising out of or in connection with this website and these Terms is limited to the greater of (a) INR 1,00,000 (Rupees One Lakh only) or its equivalent in your local currency at the date the claim arises, and (b) any amount you have paid us in respect of this website, which is ordinarily nil because access is free.

18.5

This website and its content are provided on an “as is” and “as available” basis.

18.6

The allocation of risk in this clause reflects the fact that this website is provided free of charge, and the parties agree that it is reasonable on that basis. Each part of this clause is severable, and if any part is held unenforceable the remainder continues to apply.

19.0

Client engagements

19.1

These Terms govern your use of this website. They do not govern the provision of services by us.

19.2

Client engagements, whether retainers, fixed scope sprints or other paid work, are governed by the proposal, statement of work and services agreement executed for that engagement, which deal with scope, fees, payment, revisions, timelines, ownership and assignment of deliverables, confidentiality, data processing, warranties, liability and termination. Those documents prevail over these Terms in respect of that engagement.

19.3

Nothing on this website, including any service description, price, indication of availability or case study, is an offer capable of acceptance or a commitment by us to provide services. An engagement arises only when both parties have signed the relevant documents.

20.0

Governing law and disputes

20.1

These Terms, their subject matter and their formation, including any non-contractual dispute or claim, are governed by the laws of India, without regard to conflict of laws principles.

20.2

Business users: arbitration. If you are using this website for business purposes, any dispute arising out of or in connection with these Terms or this website that is not resolved under clause 20.4 within thirty days will be referred to and finally resolved by arbitration under the Arbitration and Conciliation Act, 1996, administered by the [Mumbai Centre for International Arbitration] under its rules in force at the time. The tribunal will consist of one arbitrator. The seat of arbitration is Bengaluru, India. The language is English. The award is final and binding, and judgment on it may be entered in any court of competent jurisdiction.

20.3

Consumers: courts. If you are a consumer, clause 20.2 does not apply to you. The courts at Bengaluru, Karnataka, India have jurisdiction, but nothing in this clause deprives you of the protection of a mandatory provision of the law of the country where you live, or of your right to bring proceedings in the courts of that country. The Schedules set out further terms that may apply to you.

20.4

Resolution before proceedings. Before commencing arbitration or proceedings, each party will give the other written notice describing the dispute and the outcome sought, and the parties will attempt in good faith to resolve it. Notices to us go to hey@jxbx.it. This clause does not prevent either party from seeking urgent interim or injunctive relief from a court of competent jurisdiction, including to protect intellectual property or confidential information.

20.5

Domain name disputes. Any dispute concerning the registration or use of our domain name is subject to the dispute resolution rules of the relevant registry, which apply independently of this clause.

20.6

We make no representation that this website or its content is appropriate or available in any particular country. If you access it from outside India you do so on your own initiative and are responsible for compliance with your local law.

21.0

Complaints

Write to hey@jxbx.it. We will acknowledge your complaint within five working days and aim to give a substantive response within thirty days. Where a shorter period is required by law, including under the Digital Personal Data Protection Rules, 2025 or any applicable data protection legislation, that period applies instead.

22.0

Notices

22.1

Notices to us must be sent to hey@jxbx.it.

22.2

Where a notice commences or relates to legal proceedings, it must in addition be sent by post or courier to our registered office. Under section 20 of the Companies Act, 2013 of India, a document may be served on a company at its registered office as recorded with the Registrar of Companies, and that record is public. Our Corporate Identity Number is in clause 1, and we will confirm the address on written request to hey@jxbx.it. Nothing in this clause restricts any other method of service permitted by law.

22.3

Notices to you will be sent to the email address you have given us or, where you have given none, published on this website.

22.4

A notice sent by email is deemed received on the next working day at the place of receipt. A notice sent by post or courier is deemed received on delivery.

23.0

General

23.1

Entire agreement. These Terms, including clause 3, constitute the entire agreement between you and us in relation to this website and supersede any prior understanding in relation to it. Nothing in this clause limits liability for fraudulent misrepresentation.

23.2

Severability. If a provision of these Terms is held invalid or unenforceable in a jurisdiction, it is severed for that jurisdiction only and the remaining provisions continue in force.

23.3

No waiver. A delay or failure by either party to enforce a right is not a waiver of it and does not prevent its later enforcement.

23.4

Assignment. We may assign our rights under these Terms. We may transfer our obligations only with your consent, where permitted by law, or to a successor of our business where the transfer does not materially prejudice you. You may not assign or transfer your rights or obligations without our written consent.

23.5

No partnership or agency. Nothing in these Terms creates a partnership, joint venture, employment or agency relationship.

23.6

Third party rights. Except as stated in a Schedule, no person other than you and us has any right to enforce these Terms, and the Contracts (Rights of Third Parties) Act 1999 of the United Kingdom does not apply.

23.7

Force majeure. Neither party is liable for a failure or delay in performance caused by an event beyond its reasonable control, including natural disaster, war, civil unrest, epidemic, act of government, or failure of telecommunications, internet infrastructure or power supply.

23.8

Survival. Clauses 1, 3, 6, 8, 10, 11, 13, 16, 17, 18, 20, 22 and 23, and the Schedules, survive the termination of your right to use this website.

23.9

Language and headings. These Terms are made in English and the English text prevails over any translation. Headings are for convenience and do not affect interpretation.

23.10

Accessibility. We work to make this website usable by as many people as possible and take account of the Web Content Accessibility Guidelines in its design. We have not certified conformance to a particular level. If you encounter a barrier, write to hey@jxbx.it and we will provide the information in an accessible form and address the barrier where we reasonably can.

A term found to be unfair under Directive 93/13/EEC, the Consumer Rights Act 2015 of the United Kingdom, or equivalent local law does not bind you, and the remainder of these Terms continues to apply.

A.2

Governing law. Under Article 6 of the Rome I Regulation, the choice of Indian law in clause 20.1 does not deprive you, as a consumer, of the protection of the mandatory consumer protection rules of the country in which you habitually reside.

A.3

Jurisdiction. Despite clause 20.3, if you are a consumer you may bring proceedings against us in the courts of the EEA or United Kingdom country in which you are domiciled, and we will bring proceedings against you only in those courts.

A.4

Liability. The cap in clause 18.4 does not apply to a consumer in respect of damage caused intentionally or by gross negligence, or arising from breach of an obligation essential to the performance of these Terms.

A.5

Amendments. Despite clause 4.3, if you are a consumer we will give you at least thirty days’ notice of an amendment that materially affects your rights, and you may reject it by ceasing to use this website before it takes effect.

A.6

Data protection. Clause 3 is our privacy notice and describes the personal data we process, the bases on which we process it, our processors, our retention periods and your rights, including your right to complain to your supervisory authority. India is not the subject of an adequacy decision under Article 45 of the General Data Protection Regulation, and clause 3.7 explains the basis on which transfers are made.

A.7

Text and data mining. The reservation of rights in clause 10.7 is made expressly for the purposes of Article 4(3) of Directive (EU) 2019/790 and its national implementations, and of the corresponding provisions of United Kingdom law.

A.8

Alternative dispute resolution. We are not obliged to participate, and do not participate, in dispute resolution proceedings before a consumer arbitration board. You may raise any complaint with us directly at hey@jxbx.it.

You may appoint an authorised agent to make a request on your behalf by writing to hey@jxbx.it. We do not sell or share personal information as those terms are defined in that Act.

C.1

Non-excludable guarantees. Our services come with guarantees that cannot be excluded under the Australian Consumer Law, being Schedule 2 to the Competition and Consumer Act 2010 (Cth), or in New Zealand under the Consumer Guarantees Act 1993. Nothing in these Terms excludes, restricts or modifies those guarantees or the remedies available for their breach.

Limitation where permitted. Where the law permits us to limit liability for breach of a non-excludable guarantee, our liability is limited, at our election, to supplying the services again or paying the cost of having them supplied again.
